1. Definitions

• Service: The TypeFlick platform accessible at https://typeflick.com
• User: Any natural or legal person using the Service
• Account: Personal space created by the User on the Service
• Content: All elements (text, images, sounds, videos) uploaded by the User
• We/Our: TypeFlick, publisher of the Service

2. Service Purpose

TypeFlick is an online platform allowing users to create automated music videos from audio files and images, with customization and YouTube publishing features.

2.1 Main Features

• Creation of music videos from templates
• Upload and processing of audio and image files
• Customization of metadata (title, description, hashtags)
• Export in 16:9 landscape format
• Management of collaborators on projects
• YouTube publishing integration

3. Access Conditions

3.1 Legal Capacity

The Service is accessible to any adult natural person or minor with the authorization of their legal representatives, as well as to legal entities with legal capacity.

3.2 Registration

Use of the Service requires the creation of an Account. The User agrees to:

• Provide accurate, complete and up-to-date information
• Maintain the confidentiality of their login credentials
• Immediately notify any unauthorized use of their Account
• Be responsible for all activities performed from their Account

3.3 Technical Requirements

Access to the Service requires an Internet connection and a compatible web browser. The User is responsible for their equipment and Internet connection.

4. Use of the Service

4.1 Compliant Use

The User agrees to use the Service in accordance with its intended purpose and these ToS.

4.2 Prohibitions

It is strictly prohibited to:

• Use the Service for illegal or unauthorized purposes
• Infringe on the intellectual property rights of third parties
• Distribute illegal, defamatory, violent or pornographic content
• Attempt to bypass the Service's security measures
• Use robots, scripts or other unauthorized automated means

• Create fake accounts or impersonate others

4.3 Suspension and Termination

In case of violation of these ToS, we reserve the right to suspend or terminate access to the Service, without prior notice or compensation.

5. User Content

5.1 Content Responsibility

The User is solely responsible for the Content they upload to the Service. They guarantee that they have all necessary rights to this Content.

5.2 Usage License

By uploading Content, the User grants us a non-exclusive license, free and worldwide to use, reproduce, modify and distribute this Content as part of the provision of the Service.

5.3 Moderation

We reserve the right to moderate, delete or refuse any Content that does not comply with these ToS or applicable legislation.

5.4 Backup

It is the User's responsibility to backup their Content. We cannot be held responsible for data loss.

6. Intellectual Property

6.1 Service Ownership

The Service, its source code, databases, interfaces and all elements that compose it are protected by copyright and remain our exclusive property.

6.2 Usage License

We grant the User a personal, non-exclusive, non-transferable and revocable license to use the Service for their own needs.

6.3 Trademarks

Trademarks, logos and distinctive signs reproduced on the Service are protected and cannot be used without prior written authorization.

7. Service Availability

7.1 Best Efforts Obligation

We undertake to provide the Service with diligence and according to the rules of the art, it being specified that we have a best efforts obligation, excluding any obligation of result.

7.2 Interruptions

The Service may be interrupted for maintenance, updates, or in case of force majeure. We will strive to minimize these interruptions and inform Users in advance.

7.3 Evolution

We reserve the right to evolve, modify or remove, without prior notice, all or part of the Service for technical or commercial reasons.

8. Personal Data

The processing of personal data is governed by our Privacy Policy, which is an integral part of these ToS.

9. Liability and Warranties

9.1 Limitation of Liability

Our liability cannot be engaged for:

• Indirect, intangible or unforeseeable damages
• Loss of data, profits or business opportunities
• Malfunctions due to the User's equipment
• Acts of third parties or cases of force majeure

9.2 Cap

In any event, our liability is limited to the amount of sums actually paid by the User during the 12 months preceding the event giving rise to the damage.

9.3 User Warranties

The User warrants that they have all necessary rights to the Content they upload and agrees to indemnify us against any third-party claims in this regard.

10. Force Majeure

We cannot be held responsible for any delay or non-performance resulting from the occurrence of force majeure usually recognized by French case law.

11. Modification of ToS

These ToS may be modified at any time. Modifications come into effect upon publication on the Service. Continued use of the Service after modification constitutes acceptance of the new terms.

In case of substantial modification, we will strive to inform Users by email or by a notice on the Service.

12. Termination

12.1 Termination by User

The User may terminate their Account at any time from their account settings or by contacting us directly.

12.2 Termination by Us

We may terminate access to the Service in case of violation of these ToS, with 30 days' notice except in case of serious violation.

12.3 Effects of Termination

Termination results in the deletion of the Account and all associated data, subject to legal retention obligations.

13. YouTube API Services

TypeFlick uses YouTube API Services to enable video publishing on your YouTube channel. By using TypeFlick, you agree to be bound by:

You can revoke TypeFlick's access to your YouTube account at any time by visiting the Google security settings page.

14. Applicable Law and Jurisdiction

These ToS are subject to French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Lille.

Before any legal action, the parties will endeavor to resolve their dispute amicably. In case of failure, mediation may be considered.

15. Miscellaneous Provisions

15.1 Entirety

These ToS constitute the entire agreement between the parties regarding the use of the Service.

15.2 Partial Nullity

If a provision of these ToS were declared null or unenforceable, the other provisions would remain in effect.

15.3 Waiver

Failure to exercise a right provided by these ToS does not constitute a waiver of that right.
