Terms of Sale

These Terms of Sale govern the sale of TypeFlick services. They complement our Terms of Service and apply to all orders placed on our platform.

1. Definitions

  • Seller: Aymeric Dieu de Bellefontaine-Roy (Individual), publisher of TypeFlick
  • Customer: Any natural or legal person placing an order on TypeFlick
  • Services: Services offered by TypeFlick (subscriptions, credits, premium features)
  • Order: Act by which the Customer requests the purchase of Services
  • Contract: Agreement formed by the Seller's acceptance of the Order

2. Scope of Application

These Terms of Sale apply to all sales of Services made by the Seller to Customers who have placed orders on the TypeFlick platform.

They prevail over any other general or specific conditions not expressly approved by the Seller.

3. Services Offered

3.1 Service Description

TypeFlick offers the following services:

Free Plan

  • Limited video creation
  • Basic templates
  • Standard quality export
  • TypeFlick watermark

Premium Plan

  • Unlimited video creation
  • All templates available
  • High quality export
  • No watermark
  • Priority support

3.2 Service Evolution

The Seller reserves the right to modify, improve or remove all or part of the Services, subject to informing the Customer with reasonable notice.

4. Pricing and Payment Terms

4.1 Pricing

Service prices are indicated in US dollars (USD) and excluding any processing fees. They are available on the TypeFlick platform.

Prices may be modified at any time. Modifications apply to new orders and subscription renewals.

4.2 Payment Terms

Payment is made by:

  • Credit card (Visa, Mastercard, American Express)
  • Bank transfer (on request for companies)
  • Integrated payment solutions (Apple Pay, Google Pay)

Payment is processed securely by our service provider Stripe. No banking data is stored on our servers.

4.3 Billing

An invoice is automatically generated and sent by email after each payment. It is also accessible from the customer area.

4.4 Default of Payment

In case of default of payment, access to Services may be suspended after formal notice without effect. Late payment penalties may be applied at the legal rate in force.

5. Order and Acceptance

5.1 Order Process

The order is placed according to the following steps:

  1. Selection of desired service
  2. Verification of order summary
  3. Entry of billing information
  4. Acceptance of these Terms of Sale
  5. Confirmation and payment

5.2 Order Confirmation

The order is confirmed by sending a confirmation email containing order details and billing information.

5.3 Contract Formation

The contract is formed upon validation of payment by our service provider. Access to ordered Services is activated immediately after payment confirmation.

6. Delivery and Execution

6.1 Service Activation

Digital Services are activated immediately after payment confirmation. The Customer receives a confirmation email with access details.

6.2 Availability

We strive to ensure maximum availability of Services, subject to maintenance operations and cases of force majeure.

7. Right of Withdrawal

7.1 Principle

In accordance with Article L221-28 of the French Consumer Code, the Customer has a period of 14 days from subscription to exercise their right of withdrawal.

7.2 Exceptions

The right of withdrawal cannot be exercised for digital services whose execution has begun with the Customer's prior express agreement and express waiver of their right of withdrawal.

7.3 Procedure

To exercise the right of withdrawal, the Customer must notify us of their decision by email to [email protected] or via the contact form.

7.4 Refund

In case of withdrawal, we will refund within 14 days by the same payment method used for the initial transaction.

8. Subscriptions

8.1 Duration

Subscriptions are offered with different durations (monthly, annual). The duration is specified during subscription.

8.2 Renewal

Unless canceled, subscriptions automatically renew for an identical duration. The Customer is informed by email before each renewal.

8.3 Cancellation

The Customer may cancel their subscription at any time from their customer area or by contacting us directly. Cancellation takes effect at the end of the current period.

8.4 Suspension

In case of non-payment or violation of terms of use, the subscription may be suspended after formal notice.

9. Warranties and Liability

9.1 Warranties

We warrant that Services will be provided with diligence and according to the rules of the art. We undertake to correct any reported conformity defect.

9.2 Limitation of Liability

Our liability is limited to the amount paid by the Customer for the Services concerned. We cannot be held responsible for indirect or unforeseeable damages.

9.3 Force Majeure

We cannot be held responsible for the non-performance of our obligations in case of force majeure or circumstances beyond our control.

10. Intellectual Property

All elements of the TypeFlick platform (software, texts, images, sounds, videos, databases) are protected by intellectual property law.

The Customer only obtains a personal and non-exclusive right to use the Services, without any transfer of intellectual property.

11. Personal Data

The processing of personal data in connection with orders is governed by our Privacy Policy.

13. Mediation and Dispute Resolution

13.1 Amicable Settlement

In case of dispute, we will endeavor to find an amicable solution. The Customer may contact us via our customer service.

13.3 European Platform

The Customer may also use the European online dispute resolution platform:https://ec.europa.eu/consumers/odr/

14. Applicable Law and Jurisdiction

These Terms of Sale are subject to French law. In case of dispute, the courts of Lille shall have sole jurisdiction.

For consumer Customers, this clause does not prevent recourse to the courts of the consumer's place of residence.

15. Final Provisions

15.1 Modification of Terms of Sale

These Terms of Sale may be modified at any time. Modifications apply to orders placed after their publication.

15.2 Partial Nullity

If a clause of these Terms of Sale were declared null, the other clauses would remain applicable.

15.3 Archiving

Orders and invoices are archived on a reliable and durable medium in accordance with legal obligations.

To exercise your right of withdrawal, you may use this form or send any other unambiguous statement to the address or email above within 14 days of your subscription. Please note that the right of withdrawal does not apply once the digital service has begun with your prior express agreement and express waiver, as stated in Section 7.2 above.
